The next Plenary Meeting of the Constitutional Court was held

According to the request of the Commissioner for Human Rights (Ombudsman), the Plenary of the Constitutional Court made a decision on 01.03.2021 to verify the compliance of Article 1193 of the Civil Code of the Republic of Azerbaijan with I, III, IV and V parts of Article 25, as well as II part of Article 26, I and VII parts of Article 29, I and II parts of Article 71 and I and III parts of Article 149 of the Constitution of the Republic of Azerbaijan. The Press Service of the Constitutional Court of the Republic of Azerbaijan reported.

 

The decision states Article 1193 of the Civil Code of the Republic of Azerbaijan to be considered relevant to I, III, IV and V parts of Article 25, II part of Article 26, I and VII parts of Article 29, I and II parts of Article 71 and I and III parts of Article 149 of the Constitution of the Republic of Azerbaijan.

 

According to the Article 1159 of the Civil Code of the Republic of Azerbaijan and Article 134.1 of the Family Code of the Republic of Azerbaijan, Article 1193 of the Civil Code of the Republic of Azerbaijan, which provides for the notion of a compulsory share in the inheritance, includes the provision “children, parents of the testator,” as well as adoptees and adoptive parents.
